Please read all Terms & Conditions carefully before booking your BME Rides trip.

 

The terms and conditions set forth below (the “Terms” or “Agreement”) constitute a contractual understanding and agreement between you the trip “Participant” and BME Rides, its owners, employees, shareholders, affiliated entities, agents, representatives, officers, directors, associates, successors and assigns (individually or collectively “BME Rides,” “we,” or “us”) with respect to any and all bookings, trips or transactions made with BME Rides.

By completing and submitting a booking request form (electronic or otherwise) for any BME Rides trip you accept and agree to abide these Terms. All Participants named in a booking request are subject to the Terms.

                 

Reservations

All reservations must be made through our online booking portal, although credit card payments may be made via phone. Your reservation is not complete until you submit a complete booking form and we receive payment (deposit or full package payment). Your reservation is not finally confirmed until you receive a confirmation email from us.

All reservations must be made by the booking close date for your selected trip.

 

Deposits

A trip reservation deposit of $750 is required at the time of booking.  Single room supplements and other additions will require a $100 deposit. If a booking is made within 60 days of the trip departure date, then full pre-payment of the trip package price is required at the time of booking.

 

Final pre-payment

Final payment of the full balance of your trip package (less deposit paid) is due no less than 60 days prior to the trip departure date. If full payment is not received in this timeframe, your trip is subject to cancellation at no fault of BME Rides and applicable cancellation policies (shown below) will apply.

 

Age

The minimum age for any BME Rides trips is 18 years old. A participant must be 18 years of age or older as of the date of trip departure. In some circumstances, such as private bookings, youths from 12-18 years old may be allowed when accompanied by a parent or guardian. Any decision to allow minors on a trip will be at the sole discretion of BME Rides.

 

Although there is not set maximum age for a BME Rides participants, our tours are physically demanding. Any rider over 65 years old will be required to fill out an assessment form.

 

Participant Waiver

Every BME Rides participant must read, understand, and sign a BME Rides Participant Release of Liability and assumption of risk agreement. If required, a medical statement must be submitted by you. If you fail to submit a signed waiver and any other necessary documentation prior to departure, we reserve the right to treat your booking as cancelled by you and impose applicable cancellation fees.

 

 

Personal Medical & Travel Insurance

Personal medical insurance is mandatory for all participants joining a BME Rides trip, should be purchased once a deposit or any payment is made for a trip and you will be required to show proof of insurance prior to your departure. Insurance must provide coverage against emergency accident & medical expense (minimum $100K), accidental death & dismemberment (minimum $5K) and emergency repatriation (minimum $300K). We also strongly urge all participants to elect additional coverage for cancellation, curtailment, personal liability and loss of luggage and personal effects. If you choose to travel without adequate insurance coverage, BME Rides will not be liable for any losses whatsoever arising. Disclaimer- All World Nomads Travel Insurance plans are different, depending on your county of residence, the policy you choose and any options or upgrades you buy. Coverage described here may not be available for travelers from all countries, states or provinces. Please carefully read your policy so you know what’s covered, not covered and any limits, terms and conditions which may apply. Pre-Trip Information & Documents

It is the responsibility of all trip participants to read pertinent information on our website and all documents sent from us as soon as they are received. It is your responsibility to contact us as soon as possible if any information is incorrect or if you have any questions.

 

Flights

Each participant is responsible for booking and paying for their own flights and all attendant travel arrangements to and from the starting and/or finishing place for BME Rides trips. Participants are reminded to check airline policies and cost for excess or oversize baggage before purchasing flights. In the event of trip cancellation, BME Rides is not responsible to reimburse participant for the cost of airfare or travel arrangements to/from BME Rides trip locations. Please contact us before you book your flight to confirm that the trip has enough participants to confirm the trip or enough space for you to join (if you have not yet purchased your trip).

 

Cancellation by the Participant

All cancellations of booked trips must be made in writing and sent via email to reservations@bmerides.com. The following cancellation policies will apply:

  • 100% refund if a trip is cancelled within 7 days of booking (7-day booking window)
  • Loss of deposit if a trip is cancelled after the 7-day booking window and 60 or more days prior to the trip departure date. We will apply your deposit to another trip of equal or greater value if booked within 6 months of your cancellation date.
  • No refunds are offered for cancellations within 60 days if the trip departure date

 

Cancellation by BME Rides

Due to the nature of our trips and tour destinations, BME Rides creates trip itineraries months, if not years in advance of departures. Because of the advance planning required, sometimes unforeseen things like natural disasters, political instability or other similar events beyond our control may arise that would disrupt or compromise the safety and enjoyability of a trip. Although cancellation is rare, BME Rides reserves the right to cancel a scheduled trip at any time, what so ever. BME Rides also reserves the right to cancel a trip in the instance the minimum number of participants is not reached for a particular departure. In the case of a cancellation, BME Rides will refund all monies paid. BME Rides cannot assume responsibility for any loss incurred on account of non-refundable airline tickets. Please contact BME Rides prior to purchasing flights to confirm that the required number of participants have signed up for your trip.

 

Itinerary Changes

The trip itineraries described on our website for all BME Rides tours are representative of the activities contemplated. All participants are provided a detailed itinerary specific to their scheduled trip in advance of departure. While we make every effort to execute the trip itinerary as communicated, participant acknowledges that this kind of travel requires flexibility and understands that adjustments may be required due to local circumstances, events or unforeseen occurrences. Trip itineraries, including schedule, route, trail selection, ride times, distance, terrain, amenities, lodging, and mode of transportation may be subject to change without prior notice.

 

Lodging Single Supplements

BME Rides arranges lodging accommodations that are suitable for each trip. Most lodging will involve shared rooms. The single supplement is an additional fee for participants that request their own private room for the duration of the trip. If you are travelling on your own but do not request the single supplement BME Rides will pair you up with a roommate of the same gender. If you are travelling on your own and there is not another single person of the same gender you will be required to pay the single supplement fee. 

 

Special Requests

Any special requests must be advised to us at the time of booking (e.g. diet, room location, etc.) While every effort will be made by us to try and arrange your reasonable special requests, we cannot guarantee that they will be fulfilled. The fact that a special request has been noted on your confirmation invoice or any other documentation or that it has been passed on to the supplier is not confirmation that the request will be met. Failure to meet any special request will not be a breach of contract on our part. BME Rides does not accept bookings that are conditional upon any special request being met.

 

Tour Start Date & Time

It is your responsibility to be ready to embark on the tour as specified in the itinerary. BME Rides is not responsible for any losses due to cancelled or missed flights, changed flight itineraries, late arrivals, or early departures. Our responsibilities do not commence until the appointed time at the designated meeting point. We will do our best to accommodate guests that are delayed, however, additional charges may apply.

 

Travel Documents

It is the participant’s sole responsibility to obtain and have available when necessary the appropriate valid travel documents for the entire trip. Participants are responsible for verifying and complying with all passport, visa, vaccination, or other entry requirements and solely responsible for any adverse consequences resulting from incomplete or defective documentation. All passports must contain at least five blank pages and must be valid for six months after the completion of your trip. As a courtesy BME Rides may provide information or advice on matters such as travel documents, visas, vaccinations and entry documentation; however, we are not responsible for errors or omissions as to the information provided. All participants are advised to check with the appropriate government authority to determine the necessary documents. You may be refused entry into a country without liability for refund, payment, compensation, or credit of any kind if you do not have proper documentation. BME Rides does not accept any responsibility if you cannot travel. You agree to reimburse BME Rides in relation to any fines or other losses that could occur as a result of failure to comply with travel documentation requirements.

 

Participant Fitness Requirements

Participants must be adequately physically fit, healthy, and of proficient rider ability to undertake the itinerary set out in the chosen BME Rides tour. Each participant understands that physical fitness and mountain biking skills will be challenged during the trip and is solely responsible for assuring that personal physical conditioning, riding skills, bike, helmet and all equipment are adequate to participate safely in the trip. It is each participant’s responsibility to consult with his or her personal physician about individual physical health, fitness, and ability to participate in the mountain biking trip.

Participants further acknowledge that the nature of a mountain bike trip is adventurous, and participation involves a degree of personal risk. You may be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. You also acknowledge and clearly understand that during the course of the trip certain risks and dangers may occur, including but not limited to the hazards of travelling in mountainous regions and that by the very nature of the activities you are exposed to an element of personal risk over and above those associated with conventional tours or travel. You agree to assume all risks associated with the journey and agree that no liability will attach to BME Rides with respect of death, personal injury, illness or delay of the participant, or for any loss of or damage to the property of the participant, including to your bike or other cycling equipment, during the course of the trip. Every BME Rides participant must read, understand, and sign the Mountain Biking Proficiency Assessment & the BME Rides Participant Release of Liability and assumption of risk agreement.  Both bolded items need to link to the appropriate 

 

Your Bike

Participants are at all times responsible for the handling, maintenance, condition and care of their bikes during our trips. This includes rental bikes and personal bikes. Riders are responsible for performing bike and equipment checks to ensure gear is in proper condition and having appropriate parts and tools. Riders are responsible for the arrangement and cost of bike shipping to/from trip start and finish locations and are also responsible for building/unpacking bikes upon arrival and packing bikes at the end of the trip. Our guides are always available to assist with bike issues; however, the ultimate responsibility for bike equipment is up to the participant.

 

Images & Marketing

You agree that BME Rides may use, re-use and reproduce any images, photos, or videos that you send to us, or that are taken by our guides and/or other Participants of you individually or in a group, in any medium, including but not limited to print, electronic media, or internet, free of charge and without your right to inspection, for promoting and publicizing our travel products and services worldwide. If you do not want us to use any images of you that are taken by us or other Participants during the tour, you must inform BME Rides in advance of the tour.

 

Limitation of our Liability

BME Rides organizes, promotes, and sells tour programs consisting of certain travel services that are provided by independent third parties (“Suppliers”). All travel activities and services provided in connection the Trip including but not limited to hotels, restaurants and other food providers, tour guides, local guides, ground operators, and transportation providers, are owned and operated by independent third party contractors whose employees, facilities, products and services are not subject to the supervision or control of BME Rides. BME Rides makes no warranty, either express or implied, regarding the suitability, safety, insurance or other aspects of any Supplier and any transportation, tours, services, products or facilities provided by Suppliers. Participant understands BME Rides is not liable for any claim for loss, damage, injury, death, misrepresentation, delay, failure to deliver, partial or inadequate delivery of service, inconvenience or disappointment, arising from any action by a Supplier, including but not limited to any negligent or willful act or failure to act of any Supplier or of any other third party.

 

Theft & Loss

BME Rides, staff and partners are not responsible for lost or stolen bikes, luggage or personal items at any point during a trip. Participants are responsible for the care and prevention of theft of their bikes and gear. It is the participant’s responsibility to approve methods of loading on/off vehicles and manner of bike storage during the trip. We always recommend bringing a durable lock for added security (even in your hotel room). We strongly encourage participants to adequate travel insurance for their bikes, equipment, and personal belongings.

 

Authority to Decline Participants or Remove Participants from Trips

We reserve the right to accept or reject any person as a tour participant. We reserve the right to expel any participant from a tour if we deem this necessary for the comfort, convenience or safety of the tour participants, including if your behavior is deemed to cause or be likely to cause danger, distress or annoyance to others or if we reasonably determine your condition would adversely affect your health, safety or enjoyment or that of others. If we remove you from a trip in progress, you will not be entitled to any refund, payment, compensation or credit of any kind for unused or missed services or costs incurred resulting from the termination of the travel arrangements and you will be responsible for your travel costs to return back home.

 

Force Majeure

In no event shall BME Rides be responsible or liable for any failure or delay in the performance of its obligations hereunder arising out of or caused by, directly or indirectly, forces beyond its control, including, without limitation, acts of God, acts of war or terrorism, civil or military disturbances, nuclear or natural catastrophes, labor strikes, sickness & quarantine and unforeseen circumstances. Travel Warnings issued by the US State Department to avoid or leave a particular country may constitute Force Majeure.

If BME Rides and/or any of its Suppliers are affected by Force Majeure, they shall be entitled to, and may in their sole discretion, vary or cancel any itinerary or arrangement in relation to the tour.

 

Errors, inaccuracies and omissions

Occasionally there may be information on our website that contains errors, inaccuracies or omissions that may relate to descriptions, pricing, promotions, offers, shipping charges, transit times or availability. We reserve the right to correct any inaccuracies and to change or update information at any time without prior notice. 

 

Indemnification

Participant agrees to indemnify, defend, and hold harmless BME Rides, its owners, employees, shareholders, affiliated entities, agents, representatives, officers, directors, and associates from any claim or demand, including attorney’s fees, made by any third-party due to arising out of participant’s breach of these Terms or the documents they incorporate by reference, or participant’s violation of any law or rights of a third-party.

 

Governing Law

These Terms, the BME Rides Participant Release of Liability, and any and all separate agreements related to your participation in a BME Rides trip shall be governed by and construed in accordance with the laws of the State of Colorado, USA.
